This Agreement is by and between Swearingen 3D Works, LLC (Seller) and the Customer of any product sold by Seller, (collectively “Products”). By placing an order and accepting delivery of the product or other products, Purchaser agrees to be bound by and accepts the Terms and Conditions contained herein. These terms and conditions constitute a binding contract between the Seller and the Customer.
Swearingen 3D Works warrants that the Products will substantially conform to the then current specifications created by Swearingen 3D Works for the Products.
LIMITED WARRANTY and LIMITATION OF LIABILITY: Swearingen shall not be liable for any special, indirect, incidental or consequential damages or for loss, damage or expense, directly or indirectly arising from Customer’s use of or inability to use the Products, either separately or in combination with other Products, or for personal injury or loss or destruction of Property or from any other cause. THE WARRANTIES SET FORTH HEREIN ARE EXCLUSIVE, AND SWEARINGEN 3D WORKS EXPRESSLY DISCLAIMS ALL OTHER WARRANTIES, WHETHER WRITTEN, ORAL, IMPLIED OR STATUTORY, INCLUDING BUT NOT LIMITED TO, ANY WARRANTIES OF MERCHANTABILITY, WORKMANSHIP OR FITNESS FOR A PARTICULAR PURPOSE.

Return Policy
This Return Policy outlines the terms and conditions governing the return of products purchased from Swearingen 3D Works, LLC ("Seller"). By placing an order and accepting delivery of the product or products ("Products"), the Customer agrees to abide by these terms and conditions.
Return Process
If any Product does not conform to the specified specifications ordered, the Customer's exclusive remedy shall be repair, replacement, or a monetary refund within 30 calendar days of purchase. To be eligible for a refund, the Product must be returned in its original condition within the 30-day window. Any damage to the Product will not be eligible for a refund.
Warranty Coverage
For Products returned after the initial 30-day period, the Customer is covered by a 1-year warranty from the original purchase date for repair or replacement of the Product due to mechanical failure.
Beyond the Warranty Period
After one year from the original purchase date, the Customer must contact Swearingen 3D Works directly to discuss available options. As the Products are custom-built and crafted from high-quality materials, the likelihood of requiring replacement or repair beyond the warranty period is significantly low. Cash refunds are not guaranteed at this stage.
RESPONSIBILITY FOR INSTALLATION: Customer assumes all responsibility for the installation of any Products sold hereunder into an aircraft or otherwise. Customer represents and warrants that Customer has sufficient experience, knowledge and training to undertake installation of the Products. Customer waives, releases and agrees to indemnify Swearingen 3D Works from any claims relating to installation of the Products.
GOVERNING LAW/EXCLUSIVE JURISDICTION: These Terms and Conditions and the sale of any Products hereunder shall be governed by the laws of the State of Iowa. Any action related to this Agreement or the Products sold hereunder shall be brought exclusively in the Iowa state court for Linn County, Iowa.
